The petitioners are apprehending their arrest in connection with Jamua P.S. Case No.14/2026, registered for the offence under Sections 190, 191(2), 191(3), 115(2), 126(2), 118(1), 109, 76, 351(2), 352 of the B.N.S., pending in the Court of the learned Judicial Magistrate, 1st Class, Giridih. 3. Learned counsel appearing for the petitioners submits that the there are case and counter case between the parties and the altercation took place for digging the soil. He further submits that the allegations are made against 300-400 villagers of assembling there. He next submits that the petitioners are having 2026:JHHC:11263 -2- no criminal antecedent, as disclosed in paragraph 6 of this application. 4. Learned counsel appearing for the State opposed the prayer and submits that the petitioners were the member of unlawful assembly. 5. In the FIR, it has been alleged that about 300-400 villagers were present on the spot. There are case and counter case. In the order of the learned Sessions Judge, it has come that the injury is found to be simple in nature. The petitioners have got no criminal antecedent, as aforesaid. 6. In that view of the matter, the petitioners, above named, are directed to surrender before the learned Court within two weeks from today and the learned Court shall release the petitioners, above named, on such terms and conditions as the learned Court may deem fit and proper. 7.
