The Court made the following Order:-
The present Writ Petition is filed aggrieved by the action of respondent No.2-Municipal Corporation in issuing notice dated 03.07.2026, calling upon the petitioner to regularize the water connection by submitting the requisite documents. 2. Learned counsel for the petitioner submits that the petitioner has paid a deposit of ₹70,000/- for obtaining the water connection and has been regularly paying the water charges as levied by respondent No.2. It is submitted that, in view of the regular payment of water charges, the impugned notice has no relevance. The petitioner has also placed on record the receipts evidencing such payments. 3. Learned Standing Counsel appearing for respondent Nos.2 and 3, on instructions, submits that the petitioner is presently using Water Connection to door No.134-19-1607/1, which was originally sanctioned for an independent house, to cater to the requirements of Saudah Apartment bearing Door No.134-19-1601. It is submitted that the existing connection was sanctioned only for the independent house to meet its domestic requirements. It is further submitted that a separate water connection for the apartment has to be obtained in accordance with the applicable bye-laws, as the water requirement of an apartment building is substantially higher, for that purpose, the respondents are required to lay a separate pipeline, for which the petitioner

would have to comply with the prescribed requirements, including payment of the necessary charges and other expenses. 5. Considering the aforesaid submissions, the Writ Petition is disposed of, making it clear that the petitioner shall comply with the requirements for obtaining a second water connection. Respondent No.3 shall also inspect the site and ascertain the requirement for issuance of a second water connection to Door No.134-19-1601. Thereafter, the respondents shall issue a fresh water connection, subject to the petitioner's compliance with the prescribed requirements. It is made clear that, at any rate, the existing water connection sanctioned for the independent house cannot be diverted for use by the apartment. Further, the existing water connection catering to the needs of the independent house shall not be disturbed so long as the petitioner does not misuse the same. There shall be no order as to costs.
Pending miscellaneous petitions, if any, shall stand closed
