These bail applications under Section 483 of BNSS have been filed on behalf of the petitioners, who have been arrested in connection with FIR No.38/2023 registered at Special Police Station (SOG), District ATS and SOG for offences punishable under Sections 419, 420, 467, 468 & 120B of IPC and Sections 3 & 10 of [2026:RJ-JP:12384] (2 of 3) [CRLMB-1021/2026] Rajasthan Public Examination (Measures for Prevention of Unfair Means in Recruitment) Act, 2022. 2. Learned counsel for the petitioners submit that petitioners have falsely been implicated in this case. Counsel submit that after investigation, police has submitted the charge-sheet. Counsel submit that similarly situated co-accused persons namely, Vimla Vishnoi, Rajendra Kumar, Ashok Kumar, Satayprakash, Anil Kumar Meena & Surat Ram Meena have already been granted benefit of bail by co-ordinate Bench of this Court. Counsel submit that there are no criminal antecedents against the petitioners. It is submitted that trial will take considerable time in its conclusion. Counsel submit that the petitioners are in custody since their date of arrest and further custody of the petitioners would not serve any fruitful purpose. 3. Investigating Officer of this case Mr. Prakash Kumar Sharma, Additional Superintendent of Police is present in person. Under his instructions, learned Public Prosecutor submits that the petitioners arranged for other candidates to appear on their behalf in the examination conducted by the Rajasthan Public Service Commisssion, Ajmer. He further submits that the investigation against other co-accused persons is still ongoing, and therefore, the possibility cannot be ruled out that the release of the petitioners may adversely affect the pending investigation involving the other co-accused. 4. I have considered the contentions. 5. Having regard to the totality of the facts and circumstances of the case and considering the arguments advanced by learned counsel for the parties, especially considering the fact that [2026:RJ-JP:12384] (3 of 3) [CRLMB-1021/2026] similarly situated co-accused persons have already been granted benefit of bail by co-ordinate Bench of this Court, as also the fact that there are no criminal antecedents against the petitioners and trial will take considerable time in its conclusion, but without commenting anything on the merits/demerits of the case, I deem it fit and proper to allow these bail applications. 6. These bail applications are accordingly allowed and it is directed that accused-petitioners- (1) Dinesh Kumar son of Shri Babulal, (2) Dinesh Kumar son of Shri Aasuram Vishnoi and (3) Sampat Lal S/o Shri Laxmanaram shall be released on bail provided each of them furnishes a personal bond in the sum of Rs.1,00,000/- (Rupees One Lakh only) together with two sureties in the sum of Rs.50,000/- (Rupees Fifty Thousand only) each to the satisfaction of the learned trial Court with the stipulation that they shall appear before that Court and any Court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so. 7. However, it is made clear that the petitioners shall not involve in any other offence(s) during currency of the bail granted by this Court. 8. If breach of this condition is reported or come to the notice of the Court, the same shall alone be a reason for the trial Court to cancel the bail granted to the petitioners by this Court. 9. The observations made hereinabove are only for decision of the bail application and would not have any impact on the trial of the case in any manner. (ANIL KUMAR UPMAN),J LALIT MOHAN /49-51
