IN THE HIGH COURT OF HIMACHAL PRADESH SHIMLA Ex. Pet. No. 217 of 2026. Decided on : 21 st April, 2026. Purshottam Kumar & Anr. ...Petitioners. Versus State of H.P. & Ors. ....Respondents. Coram: The Hon’ble Mr. Justice Jiya Lal Bhardwaj, Judge. Whether approved for reporting?1 For the Petitioners: Mr. M.A. Safee, Advocate. For the respondents: Mr. Sumit Sharma, Dy. A.G. Jiya Lal Bhardwaj, Judge (Oral). Learned counsel for the petitioners fairly concedes that the judgment passed by this Court in respect of petitioner No.2 has been implemented. So far mandate in respect of petitioner No.1 is concerned, the same has been denied on the ground that he is facing a criminal trial. 2. In view of the above position, the learned counsel for the petitioner does not want to press the present execution petition, so far petitioner No.1 is concerned, at this stage, with liberty to file the execution petition at an appropriate stage. Liberty as prayed for, is granted. 1 Whether reporters of the local papers may be allowed to see the judgment? 3. So far the relief with respect to petitioner No.2 is concerned, the mandate has been complied with thereby granting him higher pay scale after completion of two years regular service, however, the arrears have not been paid to him. 4. Keeping in view the fact that the respondents have passed the order, whereby petitioner No.2 has been granted higher pay scale after completion of two years regular service, the learned Deputy Advocate General assures that all the consequential benefits emanating therefrom shall be released in his favour within eight weeks from today. 5. In view of this, nothing remains to be adjudicated in the present petition and the same is accordingly disposed of. However, petitioner No.2 is at liberty to file appropriate application for revival of the execution petition, in case, the benefits are not released to him within the aforesaid period.
