ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:-
“..to issue an appropriate writ or order more particularly one in the nature of Writ of Mandamus declaring the action of the official respondents in not taking steps to conduct an enquiry in pursuance of the petitioner’s representation, dated 06.04.2026, with regard to appointment of private respondent as Village Revenue Officer, Grade-II as he suppressed the criminal case registered against him and the action of the official respondents is illegal, arbitrary against their obligatory duties and consequently direct the official respondents to conduct an enquiry in pursuance of the petitioner’s representation dated 06.04.2026 with regard to appointment of private respondent as Village Revenue Officer, Grade-II pending criminal case against him and to pass such other order or orders as this Court may deem fit and proper in the circumstances of the case.”

The grievance of the petitioner in this writ petition is that the respondents are not taking any steps to conduct an enquiry in pursuance of her representation, dated 06.04.2026, relating to the employment of the respondent No.4 as he suppressed the crime registered against him at the time of his appointment as Village Revenue Officer, Grade – II. 3. The learned Assistant Government Pleader for Revenue placed on record a copy of written instructions of the respondent No.3 vide Rc. 4 BSB, J W.P.No.18231 of 2026 No. Ser-II / 843 / 2026, dated 20.07.2026, wherein it was stated as follows:-
“..Sri A. Girish Kumar has been appointed by Direct Recruitment to the post of Village Secretariats DSC-2019 Ananthapuramu district and appointed as Village Revenue Officer G-II vide Proceedings of the District Collector, Anantapuramu Rc. No. A4 / 3756 / 2019, dt.16.11.2019 and posted as Village Revenue Officer, Gr-II, Hemavathi-2 Village Secretariat, Amarapuram mandal and joined duty on F.N. of 18.11.2019. As could be seen from the S.R. of the individual, it is observed that the verification of character and antecedents of village and Ward Secretariats was verified by the Police Department vide C. No. 561 (III) / SB / VR.ATP / 2021, dated 28.06.2021 vide Sl. No.1513. It is observed that probation has been declared on 30.06.2022 vide Proceedings of the District Collector & District Magistrate, Anantapuramu Rc. No. Service. I / 5566 / 2021, dated Nil.-07-2022 vide Sl. No.174.
The individual has been transferred and posted as Village Revenue Officer, Grade-II B.G. Halli Secretariat, Rolla Mandal vide Proceedings of the Collector & District Magistrate, erstwhile Anantapuramu district Rc. No. Ser-I / 689 / 2024, dated 22.09.2024 in General Transfers and relieved on F.N. of 27.10.2024 from Amarapuram mandal and joined duty at Rolla mandal, on 28.10.2024. At present, the individual is working at B. G. Halli Swarna Gramam, Rolla mandal. 5 BSB, J W.P.No.18231 of 2026
In this connection, an endorsement has also been sent to the petitioner vide reference 3rd cited (Rc. No. Ser – II / 843 / 2026, dated 18.07.2026) duly informing the same. The individual has been appointed by the District Collector, Ananthapuramu through Direct Recruitment. It is an admitted fact that the case pertaining to C.C. No. 85 / 2019 before the Court of Judicial Magistrate of First Class, Madakasira in which the delinquent is acquitted. Later, an appeal is also filed and the case is pending in Crl. A.No.01/2025, dated 03.01.2025 on the file of II Additional District Court, Hindupur.”
4. In view of the above written instructions, the Writ Petition is
disposed of, directing the respondent No.1 to pass an appropriate order, on the representation, dated 06.04.2026, of the petitioner by following the due process of law, within two (2) months from the date of receipt of a copy of this order.
