JUSTICE SACHIN SHANKAR MAGADUM ORAL ORDER The petitioner has presented the captioned writ petition calling in question the legality and correctness of the order dated 24.11.2021 passed by respondent No.4, whereby the name of the petitioner has been entered in the rowdy sheet/rowdy register, as reflected in Annexure–“B”. The petitioner contends that the action of respondent No.4 in registering and - 3 - HC-KAR NC: 2026:KHC:15440 WP No. 25120 of 2025 continuing his name in the rowdy list is arbitrary and not in conformity with the procedure contemplated under law. 2. The principal grievance ventilated by the petitioner is that, though the impugned entry in the rowdy sheet was made on 24.11.2021, the petitioner has, from time to time, submitted several representations to the competent authority requesting reconsideration and deletion of his name from the rowdy register. It is specifically pleaded that despite the lapse of nearly three years, the respondent–police authorities have neither considered the said representations nor undertaken a periodical review of the continuance of the petitioner’s name in the rowdy sheet. According to the petitioner, such inaction on the part of the authorities runs contrary to the guidelines and principles laid down by this Court in the - 4 - HC-KAR NC: 2026:KHC:15440 WP No. 25120 of 2025 judgment rendered by a Co-ordinate Bench in B.S. Prakash vs. State of Karnataka and Others in W.P. No.4504/2021 and connected matters, decided on 22.04.2022, wherein this Court has emphasized the necessity of periodical review of rowdy sheets and the obligation of the competent authority to consider representations seeking deletion of names from the rowdy register. 3. In the light of the grievance articulated by the petitioner and having regard to the law laid down by the Co-ordinate Bench of this Court governing the maintenance and review of rowdy sheets, this Court is of the view that the ends of justice would be met if respondent No.4 is directed to consider the representations submitted by the petitioner and take an appropriate decision in accordance with law and in - 5 - HC-KAR NC: 2026:KHC:15440 WP No. 25120 of 2025 strict adherence to the guidelines laid down by this Court. 4. Accordingly, this Court proceeds to pass the following: ORDER i. The writ petition is allowed. ii. Respondent No.4 is hereby directed to consider and pass appropriate orders on the representations submitted by the petitioner seeking deletion of his name from the rowdy sheet/rowdy register, strictly in accordance with law and in adherence to the guidelines laid down by the Co-ordinate Bench of this Court in B.S. Prakash vs. State of Karnataka and Others (W.P. No.4504/2021 and connected cases, decided on 22.04.2022). - 6 - HC-KAR NC: 2026:KHC:15440 WP No. 25120 of 2025 iii. The aforesaid exercise shall be undertaken and completed within a period of six (6) weeks from the date of receipt of a certified copy of this order. iv.
