3. Petitioner retired from Uttarakhand Transport Corporation on 30.04.2026 as Senior Clerk. An order was passed on 29.04.2026 by the Divisional Manager (Operation) providing for recovery of `2,27,601/-.
4. Petitioner has challenged the said recovery
order by contending that petitioner is not responsible in any manner for any excess payment, which was made to him, therefore, he is not liable to recovery for some alleged mistake committed by the departmental authority. It is further contended that petitioner neither played fraud nor misrepresented
facts before the concerned authority while his pay was fixed at a higher level, therefore, in view of law laid down by Division Bench of this Court in Special Appeal No. 245 of 2022, the writ petition deserves to be allowed.
5. Mr. N.S. Pundir, learned counsel appearing for Uttarakhand Transport Corporation concedes that the issue involved is covered by the said Division Bench judgment.

6. Accordingly, the writ petition is decided in terms of the judgment dated 04.04.2024, rendered in Special Appeal No. 245 of 2022. The impugned recovery
order is quashed. Managing Director, Uttarakhand Transport Corporation is
directed to release the pending dues of the petitioner within six months from date of presentation of certified copy of this order.
