Learned counsel for the petitioner submits that the petitioner is in custody since 07.09.2025 in connection with Godda (Muffasil) P.S. Case No.237 of 2024, Special POCSO No.90/2025, registered under Sections 137(2), 96 of the B.N.S. 2023 and Sections 8 and 12 of the POCSO Act, now pending in the court of learned Additional District & Sessions Judge – cum – Special Judge (POCSO) Godda. 3. The learned counsel for the petitioner submits that the petitioner is in custody since 07.09.2025 and has been falsely implicated in this case. However, during the course of argument, it transpired that out of 7 charge sheeted witnesses, 5 have already been examined. 4. The learned counsel for the State has opposed the prayer for bail and submitted that the remaining witnesses will be promptly produced by the State. The trial is already on. 5. After hearing the learned counsels for the parties and considering the serious nature of allegation and that the trial has commenced in which only two witnesses are remaining to be examined, this Court is not inclined to enlarge the petitioner on bail. 6. At this, the learned counsel for the petitioner has submitted that the next date is 29.04.2026. 7. The learned counsel for the State is directed to ensure that the remaining witnesses are promptly produced before the court. 8. The learned counsel for the State is directed to communicate this order to the Superintendent of Police of the concerned district and 2026:JHHC:11459 2 also to the Director, Prosecution to ensure compliance so that the trial is taken to a logical end. 9.
