Affidavit of service filed in Court today is taken on record. 2. The petitioner seeks transfer. The son of the petitioner is suffering from Cerebral Palsy (75%). 3. It appears that the application was made before the school in the year 2021. The petitioner has annexed the medical certificate, issued by the Secretary and BMOH, addressed to the Head Master in September, 2021. The petitioner alleges that thereafter the application did not proceed further. 4. It appears that considerable period of time has lapsed from the day the application of the petitioner for transfer was made. 5. Accordingly, the instant writ petition stands disposed of with the observation that it will be open for the 2 petitioner to make fresh application offline seeking transfer in the prescribed format disclosing ground for the same. 6. In the event such an application is made, the same shall be considered by the District Inspector of Schools in accordance with the prevailing transfer rules. 7. As the petitioner alleges that his son is suffering from permanent medical disorder, accordingly, the Head of the Institution is directed to arrange for medical checkup of the petitioner’s son by BMOH. 8. If the petitioner is able to obtain a favourable report from the medical expert then, necessary consequential steps shall be taken by the Head of the Institution to forward the petitioner’s application to the DI of Schools without any further delay. 9. A decision shall be taken at the earliest but positively within a period of eight weeks from the date of filing of the application. 10. The fate of the petitioner’s application shall be made known to the petitioner. 11. Suspension of the Utsashree portal shall not stand in the way of the respondents in taking steps in terms of the order passed hereinabove. 12. Urgent Photostat certified copy of this order, if applied for, be furnished after completion of all requisite formalities. (Amrita Sinha, J.)
