NATARAJ ORAL ORDER The petitioners have challenged the prosecution launched against them by the respondent No.1 in C.C.No.2889/2015 on the file of the Additional Civil Judge and JMFC, Kundapura, for the offences punishable under Sections 498(A), 323, 506 read with Section 34 of the Indian Penal Code, 1860 (henceforth referred to as 'IPC'). 2. When this petition is listed for admission, the learned counsel for the petitioners submits that the accused No.1 have settled their matrimonial disputes by filing a petition - 3 - HC-KAR NC: 2026:KHC:23608 CRL.P No. 2590 of 2019 under Section 13B of the Hindu Marriage Act, 1955, before the Senior Civil Judge, Kundapura, in M.C.No.76/2021. 3. The learned counsel for the respondent No.2 does not dispute this position. 4. In that view of the matter, the continuation of the criminal proceedings against the petitioners is not warranted. Consequently, the following order is passed: ORDER i. The petition is allowed; ii. The impugned prosecution of the petitioners in C.C.No.2889/2015 on the file of the Additional Civil Judge and JMFC, Kundapura, for the offences punishable under Sections 498(A), 323, 506 read with Section 34 of the Indian Penal Code, 1860, is quashed.
