Heard the parties.
The petitioner has been made accused in connection with Hazaribagh Sadar P.S. Case No.330 of 2024 registered for the offences punishable under Sections 420, 406 of the IPC.
Learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner has committed criminal breach of trust by taking Rs.99,55,000/- for execution of a sale deed by Gango Sao but by impersonation of the Gango Sao by another Gango Sao with the same name, parentage and address of the real Gangu Sao. It is next submitted by learned counsel for the petitioner is that the allegation against the petitioner is false. The sale deed has already been executed and the registered sale deed admittedly has been executed in favour of the informant by Gango Sao with the same parentage and address is that of the real Gango Sao, which allegation is an absurdity. There is no material to suggest that there is any impersonation. The dispute between the parties is basically a civil dispute. It is next submitted that the petitioner undertakes that he will co-operate with the trial of the case and
will not annoy or disturb the informant or witnesses of the case. It is lastly submitted that the petitioner has been in custody since 27.11.2025 as mentioned in para-12 of the instant bail application. Hence it is submitted that the petitioner be released on bail.
Learned Addl.P.P. opposes the prayer for bail.
Considering the facts of this case, the above-named petitioner is
directed to be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Hazaribagh in connection with Hazaribagh Sadar P.S. Case No.330 of 2024 with the condition that he will co-operate with the trial of the case and furnish his mobile number and photocopy of the Aadhar Card in the court below with an undertaking that he will not change his mobile number during the trial of the case and will not annoy or disturb the informant or witnesses of the case.
