IN THE HIGH COURT OF ANDHRA PRADESH AT AMARAVATI
WRIT APPEAL NO: 423 of 2026 Bench Sr.No:-11 [3552] Murukuri Suryanarayana and another ...Appellants Vs. The Union of India and others ...Respondents
********** Advocate for Appellants : Ms K Indu representing Mr K L N Swamy Advocate for Respondents : Mr Jupudi V K Yagnadutt (Central Government Counsel)
CORAM : THE CHIEF JUSTICE DHIRAJ SINGH THAKUR SRI JUSTICE CHALLA GUNARANJAN DATE : 17th April, 2026 P C :
We have heard learned counsel for the parties.
2. We are of the opinion that the judgment and order impugned requires to be set aside as some of the issues would have still remained alive notwithstanding the fact that the period of lease had since come to an end and had not been extended. The appellants herein did have the right to contest the liability which may accrue during the subsistence of the lease period.
3. We, therefore, set aside the judgment and order impugned and restore the writ petition to its original number to be heard by the learned single Judge afresh.
2 HCJ & CGR, J WA_423_2026
4. The Writ Appeal is, accordingly, allowed. No order as to costs.
Registry is directed to list WP.No.5649 of 2017 before the appropriate Bench having Roster.
