1. Heard Mr. SK S. N. Mohammad, learned counsel for the petitioner. Also heard Mr. P. Borthakur, learned Additional Public Prosecutor for the State of Assam.
2. This is an application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, praying for releasing the petitioner on bail in respect of Fatasil Ambari P.S. Case No.46/2026.

3. On the day of occurrence, the petitioner, Abdul Mustak Ali @ Md. Abdul Mustak @ Tiku was driving a four-wheeler vehicle. He allegedly hit an e-rickshaw, causing it to overturn and fall upon the father of the informant, who was walking by the side of the road. The father of the informant sustained injuries and subsequently died.
4. I have considered the submissions made by the learned counsel for both sides.
5. The petitioner, Abdul Mustak Ali @ Md. Abdul Mustak @ Tiku has already spent more than 15 (fifteen) days in judicial Custody.
6. Therefore, this Court if of the opinion that for this allegation, he no longer deserves to be detained in custody. Accordingly, this bail application is allowed.
7. The petitioner, Abdul Mustak Ali @ Md. Abdul Mustak @ Tiku, who was arrested in connection with Fatasil Ambari P.S. Case No.46/2026 shall be released on bail of Rs.25,000/- with a surety of like amount to the satisfaction of the learned Chief Judicial Magistrate, Kamrup (Metro) at Guwahati.
8. With the aforesaid direction, this Bail Application stands disposed of.
