This is first bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant in Crime No. 127/2024 registered at Police Station Lailunga, District Raigarh (CG) for the offences under Sections 302, 34 of IPC. 2 (i). As per the prosecution case, co-accused Suresh Baiga, was frequently visiting the deceased's home and he wanted to marry deceased 2 Anita Bhuiya. However, deceased used to maintain relationships with other young men, which displeased co-accused Suresh Baiga. Furthermore, deceased's aunt Bhagwati Khadia, who resided in the immediate neighborhood was involved in an illicit relationship with present applicant Gopal Patel and for this reason, the deceased and her mother often engaged in altercations with Bhagwati Khadia the lover of present applicant, which caused anger to him. (ii) In the night of incident, around 11:30 PM on 27.5.2024, co-accused Suresh Baiga arrived at the deceased's home and attempted to engage in sexual relations with her. When the deceased resisted, an argument ensued between them. At that very moment, applicant Gopal Patel came from his lover’s house and upon observing the two arguing, present applicant seeking to avenge the deceased's previous altercations with his lover Bhagwati Khadia asked co-accused Suresh to "hit her”. Acting in concert, the applicant and co-accused Suresh Baiga dragged the deceased toward the backyard, threw her to the ground, removed the belt she was wearing and strangulated her to death. Thereafter, the applicant and co- accused Suresh carried the deceased’s body into the kitchen of her home and fled the scene. 3. Learned counsel for the applicant submits that the applicant is not involved in offence of murder and it is the co-accused Suresh Baiga who committed murder of deceased. He submits that the applicant is in jail since 30.05.2024 and till date out of a total 31 witnesses, only 5 have been examined and there is no immediate possibility of disposal of case, therefore, he may be enlarged on bail. 4. Per contra, learned State Counsel opposes the bail application and submits that the applicant is the main accused; on his memorandum statement, belt and blood stained clothes were seized from him. 3 5. Having considered the submissions made by learned counsel for the parties and the over all facts and circumstances of the case, I am not inclined to release the applicant on regular bail. Accordingly, this bail application is rejected. 6. However, looking to the long custody period of the applicant as he is stated to be in jail since 30.5.2024, the trial Court is directed to expedite the trial as early as possible. 7.
