15.04.2026 Heard Shri Pawan Kesharwani, learned counsel for the petitioners. 1. Petitioners have filed this petition for the following reliefs:
“10.1 that the Hon’ble court may kindly be pleased to call for the entire Records and direct the learned Judicial magistrate First Class Raigarh to decide the Interim application filed by the Digitally signed by V PADMAVATHI Date: 2026.04.16 11:10:06 +0530
Wpcr196 of 2026 2 petitioners in Case No.MJC Criminal Case-116 of 2024 as early as possible, in the interest of Justice. 10.2 That this Hon’ble court may further be pleased to pass any other order in favour of petitioner as it may deem fit and proper under the facts and circumstances of the case with cost.”

Petitioners preferred an application under Section 125 of the CrPC on 08.05.2024 along with an interim maintenance application before the Judicial Magistrate First Class Gharghoda, claiming maintenance of Rs.11,000/- per month from respondent, which was not decided till date. Hence this petition. 3. On a pointed query put to the learned counsel for the petitioners as to why the supervisory jurisdiction has not been invoked by filing the appropriate petition, for a direction to early disposal of the application for grant of maintenance/interim maintenance pending before the learned Judicial Magistrate First Class, Gharghoda, and why they have invoked the writ jurisdiction, he was unable to furnish satisfactory reply. 4. In view of above, we are not inclined to interfere with this petition. 5. Accordingly, present petition stands disposed of. However, petitioners are at liberty to pursue their prayer for expeditious disposal of their case in an appropriate proceeding.
