For Petitioner: Mr.Ram Prasath B For Respondent: Mr.P.Dhileepan Government Advocate (Crl.Side) ORDER The petitioner apprehends arrest for the alleged offence under Sections 465, 467, 468, 471, 419 & 420 of Indian Penal Code, 1860 in Crime No.211 of 2025 on the file of the respondent police seeks anticipatory bail. 2. The case of the prosecution is that in conspiracy with each other, this petitioner along with his brother (A1) and two others cheated the defacto complainant by executing a forged sale deed and impersonation. The learned counsel for the petitioner submitted that the petitioner is arrayed as A2 in this case and that the petitioner is innocent and has no connection to the alleged offence. He would also submits that both the power of attorney executed in favour of the petitioner and the sale deed executed with the defacto complainant are registered documents. The property was sold to the defacto complainant in good faith with all relevant documentation. He would further submits that the petitioner suffers from several medical ailments and is undergoing treatment for a cardiac problem. Therefore, he prays to grant anticipatory bail to the petitioner. 4. The learned Government Advocate (Criminal Side) appearing for the respondent police opposed the grant of anticipatory bail to the petitioner. While reiterating the prosecution's case, he submitted that the investigation is still pending and that there is no change in the circumstances. 5. I have given anxious consideration to the submissions made by the learned counsel on either side. 6. Considering the facts and circumstances of the case, the nature of the offence and the submissions made by the learned Government Advocate (Crl.Side) that the investigation is still pending and there has been no change in the circumstances after the dismissal of the petitioner’s previous anticipatory https://www.mhc.tn.gov.in/judis CRL OP No. 11145 of 2026 __________ Page3 of 4 bail application, this Court is not inclined to grant anticipatory bail to the petitioner. 7.
