In Re : Hemanta Murmu
... Petitioner.
Mr. Tapan Datta Gupta, Mr. Parvej Anam, Ms. Rituparna Ghosh
... For the Petitioner.
Mr. Madhusudan Sur, APP
... For the State.
Learned advocate appearing for the petitioner submits that the petitioner is in custody for about ten months and the investigation has already been concluded as charge- sheet has been submitted before the jurisdictional court. It has also been contended that 16 witnesses have been cited by the prosecution and there is no possibility of the trial concluding in the near future. As such, petitioner may be released on bail on any stringent condition. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and draws the attention of the Court to the statement of one of the eyewitnesses under Section 183 of the BNSS. I have considered the totality of the circumstances for which the present petitioner has been charged. Having considered the same, I am of the view that this is not a fit
2 case to release the petitioner on bail at this stage. As such, the prayer for bail of the petitioner is rejected. The application for bail, being CRM (M) 295 of 2026, is, thus, dismissed. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
