By way of this petition, the petitioner has inter alia prayed for quashing of impugned order dated 05.09.2017 (Annexure P-12). There is no cogent explanation given by the petitioner as to why an order passed in the year 2017 is being assailed by the petitioner after nine years.

The contention of learned Counsel for the petitioner that the petitioner could not approach the Court on account of his illness has no merit as it is not the case of the petitioner that as from the date of rejection of his representation, till date, he was totally incapacitated on account of medical reasons so as to disable him to

file the writ petition. Further contention of the petitioner that since pension is a continuing cause, he can approach the Court belatedly also does not find any merit because herein rightly or wrongly the case of the petitioner was considered by the Authority and same stood rejected on 05.09.2017. The petitioner ought to have approached the Court within some reasonable time and by no stretch of imagination, the period of nine years can be said to be a reasonable period.

Accordingly, as this Court does find the petition hit by delay and laches, the same is accordingly dismissed. Pending miscellaneous application(s), if any, also stand disposed of accordingly.
