D/L 27 10.02.2026 Bpg. C.R.M. (M) 190 of 2026 In Re: An application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 read with Section 439 of the Code of Criminal Procedure filed in connection with Raiganj Police Station Case No.14 of 2013 dated 05.01.2013 under Sections 302/34/120B/427 of the Indian Penal Code and 25/27 Arms Act; Koushik Paul @ Babai Versus The State of West Bengal Mr. Jisan Iqubal Hossain. …for the petitioner. Mr. Joydeep Roy Mr. Amanul Islam. …for the State. Mr. Sourav Chatterjee Mr. Soumya Nag Ms. Namrata Chatterjee. …for the de facto complainant. Learned advocate appearing for the petitioner prays for bail as he is in custody for 13 years. Learned advocates for the de facto complainant and the State are present. On an overall assessment, I find that final arguments of the case after the evidence was completed commenced in the year 2024. There are number of accused persons, each have been continuing with their arguments for a considerable period of time. A similarly placed accused approached this Court whose prayer for bail was rejected since the case is at the final stage. Having regard to the fact that there has been direction for 2 the court who will be in-charge of the court in absence of the regular presiding officer would be hearing out of the final arguments of the case, I am of the view that this is not a fit case for releasing the petitioner on bail at this belated stage. Accordingly, the prayer for bail of the petitioner in CRM(M)190 of 2026 is dismissed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities. (Tirthankar Ghosh, J.)
