M.CHALAPATHI SC For Nagarjuna University The Court made the following Order: Heard Sri Vijay Mathukumilli, learned counsel for the petitioner, learned Government Pleader for Higher Education, Smt. K. Radhika, learned Standing Counsel for the respondent No.2, Smt. Vallabhaneni Santhi Sree, learned Standing Counsel for the respondent No.3 and learned Standing Counsel for the respondent Nos.4 & 5. 2. Seeking a direction to the respondents to allot a seat in the 4th respondent University College of Law, the instant writ petition is filed. 3. Before filing the present writ petition, the petitioner had earlier approached this Court by way of writ petition in W.P.No.34915 of 2025, seeking allotment of a seat in LL.M., in any of the leftover seats. The said writ petition was disposed of, taking note of the fact that there were leftover seats in the 4th respondent-College and the 2nd respondent-APSCH was directed to consider the case of the petitioner for allotment of an LL.M., seat for the academic year 2025-2026. 3 4. Pursuant to the said directions, the proceedings dated 30-12-2025 were issued stating that, there is no provision under G.O.Ms.No.116 dated 07.08.2007, for filling up of the vacant seats in University colleges under the spot admission category. Unless such an approval is granted by the Government by notifying the vacant seats to be filled under the spot category, the 2nd respondent cannot provide a seat to the petitioner in a University college. 5. Therefore the 2nd respondent, as per the choice expressed by the petitioner in W.P.No.34915 of 2025 has given the option to the petitioner to choose any one of the colleges mentioned in the said proceedings. The petitioner being aggrieved by the said proceedings filed the present writ petition contending that the said colleges located at a very distance place from her place, sought to consider her case in the University college, the 5th respondent herein. 6. The learned counsel for the petitioner submits that, in the present writ petition, on 08.01.2026, this Court has granted interim direction which is as follows: “In view of the facts and circumstances of the case, respondents are directed to provide admission to the Writ Petitioner in the vacant seat of LL.M. course for the branch of Corporate Law (under Self Finance Course).” 7. The said direction was not complied with by the respondents. Thus, the petitioner filed the contempt case, at that juncture, the 1st respondent issued 4 proceedings dated 14.02.2026, directing the 2nd respondent to comply with the directions issued by this Court in W.P.No.34915 of 2025 dated 08.01.2026. Later, the Department has filed an appeal in W.A.No.773 of 2026 against the interim order passed in the instant writ petition. The Division Bench suspended the operation of the interim order, however observed that the writ petition be considered and disposed of on its merits. 8. Smt. Radhika, learned Standing Counsel appearing for the Respondent No.2 submits that, unless the Government accords permission for spot admissions, neither Respondent No. 2 nor the University can grant admission to the petitioner under the spot admission category. The respondent Nos.4 and 5 filed their counter affidavit stating that a seat meant for a reserved category cannot be allotted to a candidate belonging to a different category. Unless the Government grants permission to fill the unfilled seats through spot admission, admission to unfilled seats cannot be allowed under the spot admission category. During the course of arguments, it is also stated that no candidate belonging to SC category has at any point of time had claimed for this particular seat. 9. Having regard to the contention of the petitioner that there is a vacant seat in the respondent No.4 - University College of Arts, Commerce & Law, however, the respondents have not taken any decision to fill the said seat and as the respondent No.1 is the appropriate authority to accord permission to fill up the vacant seats under spot admission category, this Court deems it appropriate to direct the respondent No.1 to pass appropriate orders, on the 5 request of the petitioner, for grant of admission in the leftover seat in the University College of Law of the respondent Nos.4 & 5, 10. Accordingly, the Writ Petition is disposed of, directing the respondent No.1 to pass appropriate orders on the representation/request of the petitioner seeking admission into LL.M., Course in the leftover seat in the University College of Arts, Commerce,& Law, Acharya Nagarjuna University, the respondent Nos.4 & 5, within a period of two (02) weeks from the date of receipt of this order, in accordance with law. 11. With the above observation, the Writ Petition is disposed of. There shall be no order as to costs.
