Advocate S.B.: Hon'ble Shri Parth Prateem Sahu, Judge Order on Board 13/04/2026 1. With the consent of learned counsel appearing for the parties, case is hard finally. 2. Petitioners have filed this writ petition seeking following reliefs:- “10.1. The Hon'ble Court may kindly be pleased to call for the entire record pertaining to the case of the petitioner. 10.2. That this Hon'ble Court may kindly be please to direct the respondent authorities to give promotion to the petitioners on the post of Head Master after affording opportunity for counselling while maintaining the seniority of the petitioner as per the amended final seniority list published on 06.11.2024 so far as it relates to the petitioners. 4 / 6 10.3. That this Hon'ble Court may kindly be please to direct the Respondent Authorities particularly Respondent No. 2 and 3 to consider the case of petitioners for promotion to the post of Head Master and allow the same from the date private respondents and other juniors have been given benefit of promotion with all consequential benefits. 10.4. That this Hon'ble Court may kindly be please to direct the Respondent Authorities particularly Respondent No. 2 and 3 to decide the representation given by petitioners (Annexure P-8 and Annexure P-9 respectively) objectively with a stipulated time frame as this Hon'ble Court deem fit in the interest of justice. 10.5. Any other relief, which this Hon'ble Court may deems fit and proper may also be awarded to the petitioner including the cost of the petition.” 3. Learned counsel for the petitioners submits that petitioners are working on the post of Teacher (LB) T- Cadre and after completion of requisite period of service, they became eligible for promotion on the post of Headmaster Middle School. Name of petitioners though considered by Departmental Promotion Committee (DPC) convened on 26.12.2024, however, petitioners were not recommend for promotion. According to his instructions, name of petitioners were not recommended for promotion as the ACRs of some of years were not placed before DPC. He submits that according to his instructions, as of now, District Education Officers has forwarded ACRs of petitioners before the competent authority, thereby petitioners became eligible for 5 / 6 promotion. However, till date no further proceeding have been initiated by respondents. 4. Learned counsel for the State submits that he is not disputing the submission of learned counsel for petitioners that after meeting of DPC and recommendation made for promotion of other candidates in zone of consideration, District Education Officer has forwarded ACRs of petitioners. He submits that it is under consideration . He also submits that according to his instructions, as of now, respondent authorities are also considering as to whether petitioners are having requisite qualification for promotion on the post of Headmaster Middle School or not and it may take some time. 5. I have heard learned counsel for the parties and also perused the documents enclosed along with writ petition. 6. In the facts and circumstances of case where undisputedly petitioners who are holding post of Teacher have completed requisite period of service in the feeder posts, their names were considered, however, they could not be recommend for promotion as their ACRs of some years were not placed before DPC and now it is made available by the District Education Officer before the competent authority. Further considering the submission of learned counsel for State that they are considering claim of petitioners and they have also sought opinion from the Director Public Instructions which is pending consideration, I find it appropriate to dispose of this writ petition at this stage directing respondent authorities to consider and take decision on claim of petitioners in accordance with law, expeditiously, preferably within a period of 4 months from the date of receipt of copy of this order. 6 / 6 7.
