A. 18 02.03.2026 Court No.19 BP WPA 14024 of 2025 Damodar Das Mahapatra & Ors. -versus- The State of West Bengal and others Mr. Amit Baran Dash Ms. Ankana Sarkar ..for the petitioners Mr. Supratim Dhar, Sr. Advocate Mr. Kaustav Chatterjee ..for the State Affidavit of service filed in Court today is taken on record. Mr. Dhar, learned senior advocate assisted by Mr. Kaustav Chatterjee appears for the State. The learned advocate appearing for the State submits that the instant writ petition is not maintainable as the petitioner is now seeking release of the other plots after having entered into a compromise for return of one of such plots. The learned advocate appearing for the petitioners submits that one of the writ petitioners without intimating the others entered into a compromise praying for release of only one plot. However, the fact remains that the contempt application was disposed of by an order dated 17th November, 2016 wherein it was specifically recorded that the petitioners have taken possession of the land in question i.e. Plot No. 3308 and the petitioners do not wish 2 to proceed with the contempt application and accordingly the contempt proceedings are dropped. Faced with such situation, the learned advocate appearing for the petitioners prays for leave to withdraw this writ petition with liberty to take appropriate steps in accordance with law. In the light of the submissions made by the learned advocate for the petitioners, WPA 14024 of 2025 stands dismissed as withdrawn with liberty as sought for by the learned advocate for the petitioners. The report prepared by the Special Land Acquisition Officer, Tamluk, Purba Medinipur dated 20th August, 2025 filed by the learned advocate for the State is taken on record.
