G.P. for Registration and Stamps The Court made the following: 2 W.P.No.13313 of 2024 ORDER: The writ petition is filed under Article 226 of the Constitution of India, seeking the following relief: “…to issue a writ, order or direction, more particularly one in the nature of a Writ of Mandamus, declaring the action of the respondent No. 5 in mutating petitioner’s land admeasuring Ac.0.24 cents out of total extent of Ac. 0.36 cents in Survey No. 30-12 (land parcel No.261) situated in Latchayyapeta village of Burja mandal in Srikakulam district in the name of the respondent No. 7 and subsequently in the name of the respondent No. 8 by deleting the petitioner’s name in revenue records for the above said land without issuing notice to the petitioner under Section 5(3) of the Andhra Pradesh Rights in Land and Pattadar Pass Books Act, 1971 and rules framed thereunder as illegal, arbitrary, violative of principles of natural justice and provisions of the Andhra Pradesh Rights in Land and Pattadar Pass Books Act, 1971 and rules framed there under, violative of full bench judgment of the High Court of Andhra Pradesh in Chinnam Pandurangam Vs. Mandal Revenue Officer on 11.07.2011 in W.P. No. 7868 of 2004 reported in 2007 (6) ALD 248 and offends Articles 14, 21 and 300- A of the Constitution of India and consequently set aside the mutation of the respondents Nos. 7 and 8 names with respect to the petitioner’s said land and direct the respondents Nos. 2 to 5 to maintain entire record of rights in petitioner’s favour for his agricultural land and to pass…” 2.
