This subsequent application filed under section 483 of the Bharatiya Nagarik Suraskha Sanhita, 2023, the accused petitioner namely, Soleman Ali, has prayed for bail in connection with Jalukbari P.S. Case No. 94/2026 under Section 112(2)/303(2)/317/61 of BNS, 2023. 3. The case arose out of an FIR dated 19.03.2026 about missing of 19 out of 30 cows kept in Northeast Frontier Goshala Samittee under the jurisdiction of Jalukbari police station. However, during further investigation, it was found that the owner/custodian of the Goshala, Yakub Ali, in collusion with Soleman Ali and Jakir Ali had illegally sold those cows. 4. The earlier bail application was rejected by this Court on 07.04.2026 in BA 951/2026. The petitioner has been detained in custody since 20.03.2026. 5. The learned counsel for the petitioner submits that he is seeking bail on the ground of length of detention and also progress of investigation in the meantime. 6. The learned Additional Public Prosecutor submits that as reflected in the earlier order also, there are incriminating materials against the petitioner and the cattle are also yet to be recovered. 7. I have seen that there is no investigation after 26.03.2026. 8. The learned counsel for the petitioner submits that in the event of bail, the petitioner shall render full cooperation to the remaining investigation. 9. Accordingly, accepting this subsequent bail application, the petitioner Page No.# 3/3 shall be released on bail in Jalukbari P.S. Case No. 94/2026 under Section 112(2)/303(2)/317/61 of BNS, 2023, on furnishing bail bond of Rs.50,000/- with one suitable surety of the like amount to the satisfaction of learned concerned court [CJM, Kamrup(M)]. 10. The direction for bail is further subject to the following conditions: (a) That the petitioner shall co-operate with the remaining investigation; (b) That the petitioner shall not hamper or tamper with evidence; and (c) That the petitioner shall not misuse his liberty to commit any offence or illegal activities. 11. Violation or breach of any condition(s) shall entail cancellation of bail. 12. With the above observations, this bail petition stands allowed and disposed of accordingly. 13.
