1. Affidavit of service, as filed, be kept with the record.
2. The petitioner’s contention to quash and/or set aside the sale certificate, is not only belated but wholly without the jurisdiction.
3. Ms. Roy Choudhury, learned Advocate appearing for the respondent-Bank has handed up a document evidencing possession of the property being handed over to the auction-purchaser in 2023; a copy whereof is taken on record.
4. The petitioner’s remedy lies before the Debts Recovery Tribunal, not only in the application being SA 517 of 2022 which is already pending, but also by way of whatever necessary application, the petitioner may be advised.
5. With these observations, WPA 23000 of 2025 is disposed of. No order as to costs.
