The petitioner is apprehending his arrest in connection with Sakchi P.S. Case No. 205 of 2017, registered for the offence under Sections 341, 324, 326, 307 and 34 of the Indian Penal Code and Section 27 of the Arms Act, pending in the court of learned Chief Judicial Magistrate, Jamshedpur.

Learned counsel for the petitioner submits that the petitioner is the witness in S.T. No.141/2016 related with the murder of his brother against the informant of this case. He further submits that another co-accused, namely, Vivek Kumar @ Vivek Kumar Singh has been granted anticipatory bail by Coordinate Bench of this Court in A.B.A. No.7264 of 2022. He submits that other co-accused persons have also been granted anticipatory bail in A.B.A. Nos. 4546 of 2025 and 4802 of 2025 by this court. He submits that the petitioner has been falsely implicated in the case due to earlier case, in which, he is the witness.

Learned A.P.P. appearing for the State has opposed the prayer and submits that the allegations of assault is there.

Considering that in the identical situation, the other co- accused persons have already been provided the privilege of anticipatory bail in the aforementioned A.B.As. and it has been pointed out that due to enmity, the petitioner has been falsely implicated in this case as he is the witness in S.T. No. 141 of 2016 and in the attending
facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioner.

Accordingly, the above-named petitioner is directed to surrender before the learned Court within three weeks from today and in the event of his arrest or surrender, he will be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamshedpur in connection with Sakchi P.S. Case No.205 of 2017, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
