GP FOR SERVICES II The Court made the following: 2 THE HONOURABLE SRI JUSTICE NYAPATHY VIJAY W.P.No.20467 of 2026 ORDER: The Writ Petition is filed questioning the Memo dated 14.07.2026 issued vide Rc.No.C1/COE-13025(43)/37/2026 in keeping the Proceedings issued by Respondent No.2 dated 06.07.2026 in abeyance and not releasing the retirement benefits to the Petitioner as illegal and arbitrary. 2. The Petitioner was appointed as Work Inspector on 23.06.1990 vide direct recruitment in the Endowments Department vide Proceedings dated 13.06.1990 and thereafter, he was transferred to the Respondent No.3 Temple as per the Orders of Respondent No.2 on 07.01.1993. The Petitioner continued in the Respondent No.3 institution and was further promoted to the post of Assistant Engineer, Deputy Executive Engineer, and Executive Engineer in the course of his service in the years 2001, 2012, and 2023 respectively. 3. After rendering service for around 33 years in the Respondent Temple, the Petitioner retired from service on attaining the age of superannuation on 31.05.2026. Thereafter, the Petitioner submitted requisite documents for the release of retirement benefits. At that stage, an objection was taken that during the transfer to the Respondent No.3 Temple in the year 1993, no formal absorption or regularization order was issued and now specific orders were sought by Respondent No.3. 4. Taking note of the length of service of the Petitioner and the promotions as mentioned above, Respondent No.2 issued Proceedings dated 06.07.2026 authorizing Respondent No.3 to 3 release the pensionary benefits of the Petitioner. A week’s later, Respondent No.2 issued impugned Proceedings keeping the Proceedings dated 06.07.2026 in abeyance. Hence, the present Writ Petition. 5. Learned Standing Counsel for the Respondents submits that audit objections were taken with regard to passing retirement benefits, since there is no formal order of absorption into the Respondent No.3 Temple by the Respondent Authorities. 6. Heard the learned counsels. 7. As mentioned above, the Petitioner rendered 33 years of service in the Respondent No.3 Temple, i.e., from the year 1993 to 2026, and was granted promotions to the post of Assistant Engineer, Deputy Executive Engineer and Executive Engineer on various dates mentioned above. The objections with regard to a formal order of absorption or regularization order with regard to the 1993 transfer proceedings are unsustainable at this length of time. 8. Accordingly, the Writ Petition is disposed of with the following directions: i) The Memo dated 14.07.2026 issued vide Rc.No.C1/COE- 13025(43)/37/2026 in keeping the Proceedings issued by Respondent No.2 dated 06.07.2026 in abeyance is set aside. ii) Respondent No.3 shall process, sanction, and disburse the retirement benefits due to the Petitioner within a period of two months from the date of receipt of a copy of the Order. iii) There shall be no order as to costs. 4 As a sequel, miscellaneous petitions, if any, shall stand closed. __________________ NYAPATHY VIJAY, J Date: 24.07.2026 eha 5 THE HONOURABLE SRI JUSTICE NYAPATHY VIJAY WP No.20467 of 2026 Date: 24.07.2026 eha U
