Mr. Tek Ram Sharma, Advocate, for proforma respondents. Jyotsna Rewal Dua, J The petitioners-State seek review of the decision rendered in Rajender Pal Thakur Vs. State of H.P. & Ors.2 In terms of the said decision, the petitioners-State was directed to consider respondents’ case in light of the decision rendered in Bhagat Ram Vs. HRTC & Ors.3 with further direction that in case the respondents were found similar situated to the petitioner in Bhagat Ram3, they would be granted all reliefs as admissible to the petitioner in Bhagat Ram3. Despite grant of sufficient opportunity, reply to the application has not been filed by the respondents. In terms of the directions issued in Rajinder Pal Thakur2 as noticed above, the case of the respondents was to be considered in light of the decision rendered in Bhagat Ram3 and to grant all benefits to the respondents as granted to Bhagat Ram3. It is a matter of record that the review petition No.98/2024 seeking review of Bhagat Ram3 was allowed on 20.08.2024, whereby CWP No. 2108/2023 (Bhagat Ram Vs. HRTC & Ors.) has been restored to its original number. This being the admitted position, the order passed in Rajinder Pal Thakur2 is required to be reviewed. Accordingly, delay in instituting the review petition is condoned in the interest of justice. The application to stand disposed of. In view of above, the review petition is allowed. Judgment dated 19.10.2023 passed in Rajinder Pal Thakur2 is recalled. Review Petition is disposed of. Consequently, CWP No. 7836/2023 is ordered to be restored to its original number.
