Ganjhu, Advocate ---- 02/17.02.2026 Heard learned counsel appearing for the petitioners as well as the learned counsel appearing for the State. 2. Learned counsel appearing for the State submits that counter affidavit is ready, however, it has not been filed in the Registry as the matter was on Board. 3. In view of his such submission the said counter affidavit is taken on record. 4. The petitioners are apprehending their arrest in connection with Sarath P.S. Case No.17 of 2025 for the offence registered under sections 190, 191(2), 126(2), 115(2), 121(1), 125(b), 132, 109, 351(2), 352, 324(3) of BNS, 2023, pending in the court of learned Judicial Magistrate First Class Madhupur. 5. Learned counsel for the petitioners submits that there are general and omnibus allegations against all the accused persons and it has been stated that 80-92 persons were assembled at the place of occurrence who were pelting stones on the police. He further submits 2026:JHHC:11204 --2-- A.B.A. No. 1724 of 2026 that co-accused persons have been granted anticipatory bail in A.B.A. No.3104 of 2025, A.B.A No.2999 of 2025 and ABA No.4371 of 2025. He then submits that the petitioners have got no criminal antecedent as disclosed in paragraph No.13 of the petition. 6. Learned counsel for the State opposed the prayer and submits that the allegations are there of pelting stones on the police. 7. Considering that the co-accused persons have been granted anticipatory bail as aforesaid and there are general and omnibus allegations against the petitioners and the petitioners have got no criminal antecedent as disclosed in paragraph No.13 of the petition, I am inclined to grant anticipatory bail to the petitioners. 8. Accordingly, the petitioners, above named, are hereby directed to surrender before the learned Court within three weeks from today, and in the event of their surrender/arrest, the petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate First Class Madhupur in connection with Sarath P.S.
