The petitioner is seeking pre-arrest bail in connection with Madhupatna P.S. Case No.381 of 2022 corresponding to G.R. Case No.07 of 2023 registered for the alleged commission of the offences punishable under Sections 420/419/468/467/34 of the IPC, pending in the Court of the learned J.M.F.C.-IV, Cuttack. 3. Learned counsel for the petitioner, on instruction from the petitioner, submits that except the present bail application, no other bail application of the petitioner is pending in any other Court relating to the aforesaid F.I.R. 4. The allegation against the petitioner is that on 30.12.2022, the informant lodged a written report at the Madhupatna P.S. alleging that his younger brother is the joint owner of the Plot No.3358, Khata No.615 under Mouza- Baharbisinabour, Cuttack. He is the 505 share holder of the said plot, but his younger brother Sankarsan Padhi and Manager of Bank of India of Gopalpur Branch, Cuttack without his consent, conjointly with the help of the forgery photocopy of his voter identity card and PAN card mortgaging that property fraudulently and taken loan. Hence, the case. 5. Earlier, the petitioner had approached this Court by filing ABLAPL No.211 of 2023, which has been turned down by the Coordinate Bench vide order dated 09.02.2023. 6. Learned counsel for the petitioner by drawing the attention of this Court to the order dated 25.02.2026 passed by the Sessions Judge-cum-Special Judge, Vigilance, Cuttack in BLAPL No.187 of 2026 whereby the co-accused have been admitted to regular bail claims parity with co-accused Sankarsan Padhi. In view of the development in the interregnum the learned counsel on instruction submits that instead of pressing this application the petitioner would surrender before the court below, but their application may be directed to be decided on the same. 7. Regard being had to the nature of allegation against the petitioner and the fact that the earlier anticipatory bail application of the petitioner has been turned down, I am not inclined entertain the present anticipatory bail application of the petitioner, however, the petitioner is at liberty to surrender before the trial Court on or before 20.05.2026 and move regular bail application urging all the grounds as has been raised in the present petition including the ground of parity. If such bail application is moved by the petitioner, the same shall be considered by the Courts below on its merit in accordance with law on the same day. 8. It is open for the petitioner to urge all the points as has been urged in the present petition including the ground of parity before the trial Court. 9.
