The petitioner is apprehending her arrest in connection with Bankmore P.S. Case No. 31 of 2020, registered for the offence under Sections 406 and 420 of the Indian Penal Code, pending in the court of learned Chief Judicial Magistrate, Dhanbad. 3. Learned senior counsel appearing for the petitioner submits that the FIR has been instituted on the basis of typed report of the informant- Manmohan Verma, wherein it has been alleged that the owner of the registered Company namely M/s Mars Mercantiles Pvt. Ltd., where railway sleepers were being manufactured being transferred by way of an agreement dated 21.02.2017 between the informant and Mahesh Pradhan and Dinesh Pradhan for sale and purchase of 29,57,500 shares of the said Company for a total consideration amount of Rs.15.50 crores out of which agreed advance amount of one crore was not paid at the time of execution of the agreement. It has been alleged that thereafter, the informant handed over the possession and control of the Company to the said purchasers. [2026:JHHC:10962] -2- He further submits that the beneficiaries namely Mahesh Pradhan and Dinesh Pradhan have already been granted anticipatory bail in A.B.A. No.6069 of 2021. He next submits that the name of the petitioner surfaced in course of investigation and only allegation made against the petitioner is that the petitioner being the Company Secretary, has not verified the documents properly. It has further been pointed out that the petitioner has also been made accused in another case being Bankmore P.S. Case No. 354 of 2019, in which, she has also been granted anticipatory bail by this court in A.B.A. No. 1597 of 2026. 4. Learned counsel appearing for the State has opposed the prayer and submits that the name of the petitioner surfaced in course of investigation and it has been found that the petitioner being the Company Secretary, has not verified the documents properly. 5. Considering that there are allegations against the petitioner of passing shares of the Company to Mahesh Pradhan and Dinesh Pradhan and they being the beneficiaries, have already been granted anticipatory bail by the co-ordinate Bench of this Court in A.B.A. No.6069 of 2021 and the petitioner, who happens to be the Company Secretary against whom the only allegation is that she has not examined the documents properly and in that view of the matter, the petitioner, named above, is directed to surrender before the learned Court within two weeks from today and the learned Court shall release the petitioner on such terms and conditions or the sureties as the learned Court may deem fit and proper.
