Heard learned counsel for the parties. 2. By instituting this petition, the petitioner has made complicated prayer, which reads as follows:- “It is therefore humbly prayed that Your Lordships may graciously be pleased to allow this writ petition and quash letter dated 21/08/23 issued by the respondents which has been never served upon the petitioner, whereby and whereunder the LOA/award for the work under e-NIT No. SO(E&M)/aa/E/nit/22-23/43 DATED 27/01/2023 AND 23/06/23 has been cancelled and after cancelling the entire e-NIT, a fresh e-NIT bearing EPO/SG/E&M/Sirka/e-NIT/23- 24/11 dated 11/10/23 has been issued by the respondents. It is further directed for issuance of appropriate writ/writs commanding upon the respondents to cancel the 2nd notice inviting tender dated 11/10/23 which has been issued for the same work as in NIT dated 27/1/23 and further allot the 2026:JHHC:11384-DB 2 work order under NIT dated 27/01/23 to the petitioner who was declared L1 bidder in the said NIT.” 3. In this case, the record at least prima facie shows that no performer security/additional performance security was furnished by the petitioner. As a result, no work order was also issued to the petitioner. 4. The Notice Inviting Tender dated 27th January, 2023 was for repair, maintenance, dismantling, shifting, erection of HT and LT OH lines and allied works. This notice specifies that the period for completion was 365 days. 5. At one stage, the petitioner has pleaded that the letter dated 21st August, 2023 was never served upon the petitioner. However, the respondents, in their counter affidavit, have clearly stated that such communication was served upon the petitioner through registered A/D and e-mail. 6. The relief in this petition appears to have been rendered infructuous at this stage. In any event evaluation of the contentions raised in this petition would involve adjudication into seriously disputes questions of fact. This is ordinarily not undertaken when exercising extra ordinary jurisdiction under Article 226 of the Constitution of the India. Besides, this is a case of non-statutory contract and allegations of breach or failure to comply with some terms by the parties cannot normally be investigated in a petition under Article 226 of the Constitution of the India. 2026:JHHC:11384-DB 3 7. For the above reasons, we dispose of this petition leaving it open to the petitioner to resort the ordinary remedies, in case the petitioner chooses to. 8.
