Learned counsel Mr. Sandeep Kothari on the previous date was directed to get the instructions and today on instructions he submits that the petitioner is seeking permission to withdraw the instant petition with a liberty to file a statutory appeal against the order of Assistant Collector, First Class, Haridwar, dated 09.09.2016 passed in Revenue Case No. 03 of 2012 (renumbered as 30 of 2015), which was proceeding under section 229B of U.P.Z.A.&L.R. Act. 5. In such view of the matter, the permission to withdraw the instant petition is granted and the writ petition is dismissed as not pressed at this stage with a liberty to the petitioner-Municipal Corporation to file a statutory appeal against the order of Assistant Collector as aforesaid. 6. If such an appeal is filed then the Appellate Authority may decide the appeal on its own merit without being influenced with the order of Board of Revenue dated 09.04.2025 in S.A. No. 23/2021-22. 7.
