This petition under Section 483 of the BNSS, 2023 has been filed by the accused-petitioners, namely, Puna Gogoi and Narayan Chutia, praying for grant of bail in connection with Silapathar P.S. Case No. 57/2026 under Section 305 of BNS, 2023. 3. The petitioners were arrested on 18.04.2026 based on an FIR dated 17.04.2026, alleging that on 18.03.2026, two cows of the informant were stolen and that present petitioners are involved in the same. 4. The learned counsel for the petitioners submits that apart from the FIR being lodged almost a month after the alleged incident, the same is also counter-blast to FIR filed on behalf of Babita Chutia, sister-in-law of Rajiv Chutia from whom the alleged involvement of the petitioners in the theft of cow was revealed as per the FIR. In the said subsequent FIR dated 18.04.2026, the allegations pertain to assault. 5. The case diary has been received. 6. The learned Additional Public Prosecutor fairly submits that he did not find any direct implications against the petitioners. However, the alleged stolen cows have not yet been recovered. The investigation is pending. 7. It appears from the statement of one witness that as the petitioners are engaged in business of trading in cows, suspicions have been cast upon them. It is true that the FIR was lodged a month after the incident. 8. Seen the progress of investigation and in the circumstances, the petitioners, named above, shall be released on bail in connection with Silapathar P.S. Case No. 57/2026 under Section 305 of BNS, 2023, on furnishing bail bond of Rs.25,000/- each with one suitable surety each of Page No.# 3/3 the like amount to the satisfaction of learned concerned court [CJM, Dhemaji]. 9. The direction for bail is further subject to the following conditions: (i) they shall co-operate with the remaining investigation; and (ii) they shall not hamper or tamper with evidence. 10. Violation or breach of any condition(s) shall entail cancellation of bail. 11. With the above observations, this bail petition stands allowed and disposed of accordingly. 12.
