3. The present Criminal Misc. Application has been filed by the applicant challenging the
order dated 08.04.2026 passed by the court of learned Judicial Magistrate-III, District Dehradun in Misc. Case No. 06 of 2026, Anita Gusain Vs. Saurabh Gosain and Others, under Sections 17, 18, 19, 20 and 22 of Protection of Women from Domestic Violence Act, 2005 and the entire proceedings arising out from it.

Learned counsel for the applicants would submit that applicant no. 2, who is father of applicant no. 1, is a senior citizen aged about 70 years and applicant no. 3, who is mother of applicant no. 1, is aged about 69 years and she is 57% physically disabled. Applicant no. 1 is working in Chennai, as Senior Manager in BPCL. It is further submitted that marriage between the applicant no. 1 and respondent no. 2 was solemnized on 18.05.2025. It is an admitted case that both of them were divorcees and this was their second marriage. After some time of their marriage, matrimonial discord took place and respondent no. 2 when to her parental house in Dehradun. It is further submitted that just to harass and victimise the applicant, the present complaint has been filed.
5. Heard learned counsel for the applicant and perused the record.
6. Perusal of the impugned order dated 08.04.2026 reveals that the evidence collected was placed before the learned court below, which, after applying its judicial mind, has rightly passed the aforesaid order.
7. The court concerned has considered & discussed all relevant aspects. Thus, the view taken by the learned Magistrate concerned cannot be faulted. This Court does not find any infirmity or illegality in the impugned
order dated 08.04.2026 passed by the court of learned Judicial Magistrate-III, District Dehradun in Misc. Case No. 06 of 2026, Anita Gusain Vs. Saurabh Gosain and Others, under Sections 17, 18, 19, 20 and 22 of Protection of Women from Domestic Violence Act, 2005. Hence, this Court does not find any reason to interfere with the impugned order.
8. Accordingly, the criminal misc. application fails and is hereby dismissed.
9. However, it is always open for the applicants to raise all their grievances before the learned Trial Court concerned.
