The petitioner is apprehending his arrest in connection with Itkhori P.S. Case No. 139 of 2025 registered under Rule 4/54 of Jharkhand Minor Minerals Concession Rule, 200, section 4/21 of Mines and Minerals (Development & Regulation) Act, 1957, pending in the Court of learned Additional Chief Judicial Magistrate, Chatra. 3. Learned counsel for the petitioner submits that petitioner is owner-cum-driver of the tractor and allegations are made that illegally 100 cft sand was loaded on the said vehicle. He next submits that before the learned Sessions Judge submission was made that petitioner has got no criminal antecedent. He then submits that petitioner earns his livelihood by way of driving the vehicle. On these grounds, he submits that the petitioner may kindly be provided privilege of anticipatory bail. 4. Learned counsel for the State opposes the prayer and submits that illegally sand was being carried on the said vehicle. 5. Considering that that petitioner is owner-cum-driver of the tractor and it has been pointed out that petitioner earns his livelihood by way of driving the vehicle and in that view of the matter, petitioner is directed to surrender before the learned court within two weeks from today ( 2026:JHHC:11232 ) and the learned court shall release the petitioner on terms and conditions and sureties as learned court deems fit and proper. 6.
