Instant petition under Section 482 BNSS is filed seeking pre-arrest bail of the petitioner in connection with C.T. (Spl.) Case No.02 of 2026 pending in the file of learned Sessions Judge-cum-Special Judge, Jajpur arising out of Kuakhia P.S. Case No.551 of 2025 on the grounds stated. 3. There is allegation of mischief committed by the petitioner as made to reveal from the FIR. According to the informant, it is alleged therein that the petitioner committed the alleged excess and damaged a four-wheeler and abused him in filthy language. It is informed to the Court that the petitioner is a Sarpanch and he is having no other criminal antecedent. It is submitted that the petitioner is having three other criminal antecedents lodged at the time of election. From the FIR, the Court finds that no one received any injury not even the informant on account of the overt act committed by the petitioner, who is, however, responsible for causing damage to a four-wheeler. Having regard to the above facts and objection of the State and since, the petitioner to be a Sarpanch, though, the Court is not inclined to grant him pre-arrest bail, however, is in favour of his release on bail upon his surrender before the court concerned. 4. Accordingly, it is ordered. 5. In the result, the ABLAPL is disposed of with the direction as aforesaid. In the event, the petitioner surrenders before the court of learned Sessions Judge-cum-Special Judge, Jajpur within a fortnight, he shall be released in connection with C.T. (Spl.) Case No.02 of 2026 corresponding to Kuakhia P.S. Case No.551 of 2025 upon furnishing a bail bond of Rs.40,000/-(rupees forty thousand) with one solvent surety for the like amount with such other conditions imposed by the court concerned as deemed just and proper and in the facts and circumstances of the case. 6.
