No. 95 of 2024 arising out of Kuchai P.S. Case No. 21 of 2023 for the offence registered under Sections 380/34, 395 of the Indian Penal Code pending in the Court of learned Principal District and Sessions Judge, Seraikella is pressed into motion. It is submitted by the learned counsel on behalf of petitioner that he is not named in the FIR and similarly situated co-accused persons have been granted bail. Learned A.P.P. opposed the bail petition. It is submitted that the trial is at its penultimate stage as out of seven, six witnesses have been examined. In cases of dacoity, victim of the offence cannot be expected to know the name of the offenders, therefore, non-mentioning of the name of the accused in the FIR, does not have any bearing. Considering the stage of trial, I am not inclined to enlarge the petitioner on bail. Accordingly, the prayer for bail of the petitioner, is hereby, rejected.
