Instant writ petition under Article 226 of the Constitution of India has been preferred by the petitioner challenging the eviction warrant (Anneuxre P-1) dated 01.04.2026 issued by Tahsildar, Dantewada, District South Bastar, Dantewada (C.G.) 2. Counsel for the petitioner submits that aforesaid eviction warrant has been issued by the Tahsildar in pursuance of the order dated 10.02.2026 passed by it in Revenue Case No.2025005160400056/ v -68 /2024-25. He furthers further submits 2 that appeal preferred by the petitioner against the order of Tahsildar dated 10.02.2026 has also been dismissed by the Sub Divisional Officer (Revenue), Dantewada. 3. In reply, learned counsel for the State submits that after providing due opportunity of hearing to the petitioner, Tahsildar Dantewada has passed the order dated 10.02.2026. Appeal preferred against the order passed by the Tahsildar has also been dismissed, therefore, eviction warrant (Annexure P-1) has been issued. He further submits that there is provision of filing second appeal under Section 44 (2) of the Chhattisgarh Land Revenue Code, 1959 (for short, Code, 1959”)against the order passed by the SDO (R) in first appeal, therefore, this petition is not maintainable. 4. Heard learned counsel for the parties and perused the material available on record. 5. Having considered the aforesaid facts that after providing opportunity, eviction warrant has been passed by Tahsildar, Dantewada and upheld by the SDO (Revenue), Dantewada, therefore, this Court is not inclined to entertain instant petition invoking extraordinary jurisdiction of this Court. Hence, the writ petition is dismissed at the motion stage itself. However, the petitioner is at liberty to take recourse to law under Section 44(2) of the Code, 1959. 6. With the aforesaid observation & direction, the writ petition is disposed of. 7. Pending interlocutory application (s), if any, also stands disposed of.
