1. Present petition was admitted vide order dated 27.07.2026. Having admitted the petition, this Court granted stay to the execution of impugned order till final disposal of writ petition subject to condition that the petitioner deposits an amount of Rs.30,00,000/- with this Court before 31.08.2026. It is directed that the interim order shall operate after the amount is deposited in compliance of the said order. 2. Present application is filed seeking modification of said order. The prayer made is that instead of deposit of amount, permission to furnish bank guarantee for the said amount of Rs.30,00,000/- be granted. 3. Mr. Wachasundar, learned advocate for petitioner states that
2 1-caw-2147-2026.odt due to financial constrains, it will not be possible to comply with the condition and that the bank guarantee proposed to be furnished will sufficiently take care of interest of the respondent. 4. Mr. Sohoni, learned advocate for the respondent opposed the prayer made. He contends that the petition has been admitted and may come up for final hearing in near future. Learned advocate contends that the bank guarantee is issued for a particular period and that in the event the period of bank guarantee expires, the same will have to be renewed time and again and that it may not be possible to keep track of the bank guarantee all throughout. 5. Having heard the respective submissions as aforesaid, in the considered opinion of this Court, rather than permitting the petitioner to furnish bank guarantee as prayed, it will be appropriate to grant installments to deposit the amount. 6. The petitioner is directed to deposit the amount of Rs.30,00,000/- in five installments, first installment of Rs.10,00,000/- to be deposited with this Court on or before 30.09.2026 and other four installments of Rs.5,00,000/- each be deposited on or before 31.10.2026, 30.11.2026, 31.12.2026 and 31.01.2027 respectively. 7.
Failure to deposit the amount as directed will result in vacation of interim order granted by this Court on 27.07.2026 without further reference to this Court and the impugned order shall become
