This application under Section 483 of BNSS, 2023 has been filed by the Page No.# 2/3 petitioner, namely, Sofiqul Islam, seeking bail in Basistha P.S. Case No. 135/2026 under Section 305(a) of BNS, 2023. The petitioner is behind the bars since 30.04.2026. 3. Case diary is received. Perused the same. 4. It is submitted by Mr. Haque, learned counsel for the petitioner that the present accused petitioner is innocent and only on suspicion, the FIR has been lodged against him. He further submitted that the accused petitioner is a delivery boy of chicken and on that day also, he came for delivery of chicken, but on suspicion only, he got arrested, though nothing has been seized from his possession. 5. Mr. Sarma, learned Additional Public Prosecutor, Assam, submitted in this regard that from the FIR, it is seen that on earlier occasion also, he committed theft in the said broiler farm and on the day of the incident, he was supposed to commit theft in the shop of the informant when he caught red handed. 6. Hearing the submissions made by the learned counsel for both sides, I have also perused the case diary. 7. Considering the materials available in the case diary and the period of detention already undergone by the accused petitioner, this Court is of the opinion that further custodial interrogation of the petitioner may not be necessary for the purpose of investigation. Accordingly, this Court finds it to be a fit case to extend the privilege of bail to the present accused petitioner. 8. Accordingly, the accused petitioner, Sofiqul Islam, be released on bail on furnishing a bail bond of Rs.20,000/- (Rupees Twenty Thousand) only, with one Page No.# 3/3 surety of like amount to the satisfaction of the learned Chief Judicial Magistrate, Kamrup (M), Guwahati. The accused petitioner, named above, be enlarged on bail, subject to the following conditions:- (i) that the petitioner shall make himself available for interrogation by the Investigating Officer, as and when required; (ii) that the petitioner shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/them from disclosing such facts to the Court or to any police officer; and (iii) that the petitioner shall not leave the jurisdiction of the learned CJM, Kamrup (M), Guwahati, without prior permission. 9.
