PUBLIC PROSECUTOR 2 Dr.YLR, J Crl.P.No.5872 of 2026 Dated 24.07.2026 The Court made the following: ORDER: The Criminal Petition has been filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to enlarge the Petitioners/Accused Nos.1 to 3 on bail in Crime No.72 of 2026 of Chatrai Police Station, Eluru District, registered against the Petitioners/Accused Nos.1 to 3 herein for the offences punishable under Section 80(2) read with 3(5) Bharatiya Nyaya Sanhita, 2023 (for brevity ‘the BNS’) 2. The prosecution alleges that the deceased, Mohana Chandralekha, developed a love relationship with Accused No.1, who allegedly took her away and married her with the support of the other accused. After the marriage, all the accused allegedly subjected her to physical and mental cruelty, demanding dowry, abusing her, humiliating her on caste grounds, and threatening to arrange a second marriage for Accused No.1 within their caste. It is further alleged that on 24.05.2026, the accused assaulted, humiliated, and drove her out of the matrimonial home, instigating her to commit suicide. Unable to bear the continuous harassment, the deceased allegedly committed suicide by hanging herself on 26.05.2026 at her parental house. 3. Mr. K.V. Aditya Chowdary, learned Counsel for the Petitioners, submits that the FIR is false, politically motivated, and lodged only to harass the Petitioners, while ignoring the complaint made by Accused No.1 alleging honour killing due to the inter-caste marriage. It is submitted that the 3 Dr.YLR, J Crl.P.No.5872 of 2026 Dated 24.07.2026 allegations of dowry harassment and abetment of suicide are vague, omnibus in nature, unsupported by any specific overt acts, and inconsistent with the remand report and other material on record. The deceased had not lodged any complaint against the Petitioners during her lifetime, despite her presence at the police station prior to the incident, and the prosecution has suppressed material evidence, including call detail records and CCTV footage. It is further submitted that the investigation suffers from procedural irregularities, including non-supply of case material under Section 230 of ‘the BNSS.,’ and that Petitioners Nos.2 and 3 are elderly persons with no specific role attributed to them. The Petitioners have no criminal antecedents, undertake to cooperate with the investigation and trial. Therefore, he urged that the present petition be allowed. 4. Per contra, Mr.A. Sai Rohit, learned Assistant Public Prosecutor, vehemently opposed the grant of bail to the Petitioners. It is submitted that the investigation is not completed and some more material witnesses have to be examined. Hence, it is urged that the petition be dismissed. 5. Heard the learned counsel for the Petitioners and the learned Assistant Public Prosecutor. Perused the record. 6. As seen from the record, the de-facto complainant, who is the father of the deceased, alleges that the deceased was subjected to continuous cruelty and harassment by the Petitioners, which ultimately drove her to commit suicide within seven years of her marriage. The allegations are grave and 4 Dr.YLR, J Crl.P.No.5872 of 2026 Dated 24.07.2026 serious in nature. The Petitioners were arrested on 26.05.2026 and have been in judicial custody for the past 89 days. So far, only seven witnesses have been examined, and the investigation is at a crucial stage. Therefore, the request of the Petitioners is not found convincing and reasonable. 7. Having regard to the facts and circumstances of the case, the gravity of the allegations, and the stage of the investigation, this Court is not inclined to enlarge the Petitioners/Accused Nos.1 to 3 on bail at this juncture. Accordingly, the Criminal Petition is liable to be dismissed. 8. In the result, the Criminal Petition is dismissed. As a sequel, miscellaneous petitions, if any pending, shall stand closed. _________________________ DR. Y.
