Learned counsel for the petitioner submits that the petitioner is in custody in connection with Basantrai P.S. Case No. 72/2024 for the offence registered under Sections 190, 191(2), 191(3), 333, 115(2), 126(2), 118(1), 352, 351(2), 351(3), 109 & 103(1) of the B.N.S. 2023, now said to have been pending in the court of learned District and Additional Sessions Judge-V, Godda. 2. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case and he is in custody since 01.09.2025. The learned counsel submits that there is general and omnibus allegation so far as the petitioner is concerned. He submits that similarly situated co- accused have been granted bail by co-ordinate Bench of this Court, namely, Anju Devi and Manohar Mandal in B.A. No. 10454/2025 dated 03.12.2025; Kiran Devi in B.A. No. 3053/2025 dated 21.04.2025 and Sarita Devi in B.A. No. 1456/2025 dated 20.02.2025. 3. Learned counsel for the State has opposed the prayer and has submitted that the witnesses have supported the allegation against the petitioner including Kusam Devi at paragraph 5 of the case diary . 4. To this, the learned counsel for the petitioner has submitted that said Kusmi Devi is apparently a hearsay witness. 2026:JHHC:10981 2 5. After hearing the learned counsel for the parties and considering the fact that there is general and omnibus allegation against the petitioner and that the aforesaid co-accused have been granted bail by this Court, the petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rs. Twenty-Five Thousand) with two sureties of the like amount each to the satisfaction of the learned District and Additional Sessions Judge-V, Godda in connection with Basantrai P.S. Case No. 72/2024, subject to the following conditions: - (i) One of the bailors would be the present pairvikar of the petitioner. (ii) The other bailor should be his close relative. (iii) The petitioner will attend the court on each and every date and on account of his single default, the learned court shall cancel the bail bond furnished by the petitioner. (iv) The petitioner would deposit a self-attested copy of his Aadhar Card along with his Mobile Number before the learned court below, which he shall not change during the pendency of the case without prior permission of the court. (v) The petitioner shall fully co-operate with the proceedings before the learned court below. 6. The instant bail application is allowed with the aforesaid conditions. 7.
