The petitioners are apprehending their arrest in connection with Complaint Case No.72 of 2025, for offence registered under section 33(1)(C) of Indian Forest Act, pending in court of learned Sub Divisional Judicial Magistrate, Chatra.

Learned counsel for the petitioners submits that false allegations are made in this case alleging that the petitioners were preparing for cultivation of poppy plant in the forest land. He next submits that even the land is not belonging to the petitioners and the petitioners have got no criminal antecedent as disclosed in paragraph no.17 of the petition.
4. Learned State counsel opposes prayer and submits that the allegations are there of cultivation of poppy plant.
5. Considering that the land is of the forest department and it is

not belonging to the petitioners and the allegations are made of preparing for cultivation of poppy plant in the forest land and further the petitioners are having no criminal antecedent as aforesaid, and in that view of the matter, the petitioners, above named, are directed to surrender before learned court within two weeks from today, and the learned court shall release petitioners, above named, on such terms and conditions as well as sureties as learned court may deem fit and proper.
6. A.B.A. No. 993 of 2026 is disposed of.
