JUSTICE RAJESH SHANKAR ----- For the Petitioners : Mr. Rajendra Krishna, Advocate Mrs. Priya Sahay, Advocate For the Opposite Party No. 2 : Mr. Amrit Raj Kisku, AC to GA-V ----- 15/18.04.2026 The present contempt petition has been filed for initiating a contempt proceeding against the contemnors/opposite parties alleging wilful violation of the order dated 29.01.2024 passed in W.P.(S) No. 5125 of 2023. 2. A supplementary show cause affidavit has been filed on behalf of the opposite party no. 2. 3. Mr. Amrit Raj Kisku, AC to GA-V appearing on behalf of the opposite party no. 2, refers to paragraph nos. 6 & 7 of the said affidavit which read as under: “6. That it is most humbly stated and submitted that the status for payment of arrears of salary and other benefits in compliance of the writ court’s order is that out of 48 petitioners, all petitioners have been paid the arrears of salary and other retiral benefits including Earned Leave and etc. 7. That it is most humbly stated and submitted that the answering opposite party has taken every endeavour and steps for fixation and disbursement of pension from his end for full compliance of the writ court’s order and the present status of the same are as under. * That with regard to 12 petitioners, Accountant General, Jharkhand has already approved pension and PPO has been issued. * That with regard to 32 petitioners the pension papers and service books have been sent to the Accountant General, Jharkhand for necessary steps for issuance of PPO vide letter dated 12.09.2025, 13.09.2025, 13.10.2025, 10.11.2025, 11.11.2025, 12.11.2025, 10.02.2026, 01.04.2026. That with regard to 30 petitioners, the approval of pension is still awaited from the office of Accountant General, Jharkhand. The concerned District Transport Offices vide letters dated 16.12.2025, 2026:JHHC:11258 3 19.12.2025, 30.12.2025, 08.01.2026, 16.03.2026, 18.03.2026 and 02.04.2026 has sent for approval of pension. * That with regard to the 02 petitioners’ offline filling of pension papers, the approval has been granted by the Directorate of Pension and Accounts, Jharkhand vide letter dated 10.10.2025 and 27.11.2025, thereafter the pension papers are being prepared and the same shall be sent to the office of Accountant General, Jharkhand at the earliest without any further delay. * That with regard to 02 petitioners, the same is under process as one of the petitioner’s pension papers has to be prepared of this legal heir.” 4. Learned AC to GA-V submits that the pension amount shall positively be paid to the petitioner who are still awaiting for the same within six weeks from today. 5. Considering the said submission, this Court is of the view that there is no need to further proceed in the contempt petition. The contempt proceeding as against the opposite party no. 2 is hereby dropped. 6. The contempt petition is accordingly disposed of. 7. It is, however, observed that if the pension amount of the petitioners is not paid within a period of six weeks from today, the aggrieved petitioners are at liberty to prefer a fresh contempt petition in this regard.
