Mr. Vinay Pandey learned Deputy Advocate General appearing for the State would submit that the petitioner is posted on the post of Siksha Karmi Grade-III and its nomenclature has already been changed from Siksha Karmi Grade-III to Assistant Teacher (Grant) in recruitment rules, but in the promotion rules, nomenclature has not been changed yet and proposal is pending consideration since 2021 before the State Government. He would submit that in absence of adequate rules, the claim of the petitioner for promotion could not be considered. 2. Dr. Sudeep Agrawal, learned counsel appearing as Amicus Curiae would submit that the proposal for change in nomenclature in the promotion rules is pending consideration before the State Government since 2021 and till date no decision has been taken for reasons best known to the authorities concerned. 3. The claim of the petitioner appears to be genuine as he is claiming promotion from post of Assistant Teacher to Upper Division Teacher, but in absence of change in nomenclature in the promotion rules, he has not been promoted to the said post. 4. Heard. 5. Taking into consideration the above discussed facts, respondent No.1 is directed to take decision with regard to change of nomenclature in the Rules of Chhattisgarh Ashaskiya Shikshan Sanstha (Skulo Me Karyarat Adhyapako Tatha Anya Karmachariyo Ki Padonnati) Niyam, 1988 or respondent authorities shall give effect to draft rules. The entire exercise shall be completed by respondent No. 1 within a period of 120 days from today and thereafter the claim of the petitioner for 3 promotion shall be considered accordingly within further period of 90 days. 6.
