Mr. Yogesh Kumar Pacholia, learned counsel for the respondent-AICTE. 4. Petitioner has challenged order dated 21.06.2023 passed by Engineer-in- Chief (HOD), Public Works Department. By the said order, petitioner’s claim for promotion to the post of Assistant Engineer (Civil), against degree holder quota post, was rejected by holding that the institution, from which petitioner acquired Bachelor of Engineering Degree, was not recognised by All India Council for Technical Education (AICTE). 5. This position is not disputed by learned counsel for the petitioner. In fact, petitioner has sought amendment in the writ petition to incorporate one more prayer for quashing of public notice issued by AICTE on 03.08.2017. 6. Public notice dated 03.08.2017 is on record as Annexure 6 to the writ petition. Perusal whereof indicates that Ministry of Human Resources Development, Government of India had issued an order on 06.12.2012, whereby recognition granted to Degree/Certificate in the field 2026:UHC:4475-DB of technical education acquired through distance mode was withdrawn w.e.f. 31.05.2013. 6. Admittedly, petitioner took admission in B.Tech. course in Institution of Civil Engineers, Ludhiana (Punjab) in 2014, and such degree was awarded to her in 2017. 7. In view of decision taken by Ministry of Human Resource Development as well as notification dated 03.08.2017 issued by AICTE, pursuant to that decision, petitioner is no more eligible to be promoted against the degree holder quota post, as only valid B.Tech/B.E. degree holders can be promoted against that quota. 8. Thus, there is no scope for interference in the matter. The reason for rejecting petitioner’s claim do not suffer from any infirmity. 9. Accordingly, the writ petition fails and is dismissed.
