The petitioner is running the restaurant called 'Paakashala' as a lessee in the property bearing Sy No.172, Jaladagere Village, Yediyur Taluk, Tumkur District situated on the National Highway-75.
2. The petitioner has approached this Court being aggrieved by show cause notice dated 17.12.2021 (Annexure-E) issued by the National Highways Authority of India (NHAI) for removal of alleged unauthorized

construction in violation of mandatory provisions of distance from the National Highway.
3. The petitioner has already submitted a reply to the show cause notice vide reply dated 29.12.2021. The petitioner has approached only against the show cause notice dated 17.12.2021. This Court is not inclined to interfere with the show cause notice.
4. Respondent No.3 is directed to consider the reply and take an appropriate decision on the show cause notice, in accordance with law. However, the petitioner should be given an opportunity of hearing, for which the NHAI is directed to issue notice before passing any order.
5. It is needless to state that if any action pursuant to the show cause notice should be taken only after the said show cause notice is decided. The NHAI is

directed to decide the show cause notice expeditiously, preferably within a period of one month from today.
6. With the above observations, the writ petition is disposed of.
