05.01.2026 Sl. No.63 NB CRM (A) 4209 of 2025 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure, 1973 corresponding to Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Baishnabnagar PS Case No.49/2025 dated 14.01.2025 under Section 21(C)/29 of the NDPS Act. And In the matter of: Chandramohan Mandal @ Chandra Mandal … petitioner Mr. Arup Kumar Bhowmick. …for the petitioner. Mr. Bibhaswan Bhattacharya, Ms. Sanjida Sultana. …for the State. Report filed on behalf of the State is taken on record. Learned counsel appearing on behalf of the petitioner submits that other than the statement of a co-accused, there are no incriminating materials available against the present petitioner. Learned counsel appearing on behalf of the State submits that between 02.01.2025 and the date of occurrence i.e. 13.01.2025, there were as many as 2092 phone calls made between the present petitioner and the principal accused. On 13.01.2025, their location was the same as per the call tower records. Besides, a proclamation has been issued against the present petitioner. Considering the above and the other incriminating materials available in the case diary and the restriction contained in Section 37 of the NDPS Act, I do not consider this to be a fit case for granting anticipatory bail. 2 The application for anticipatory bail is, thus, rejected. Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities. (Jay Sengupta, J.)
