Learned counsel for the petitioner submits that the petitioner is in custody in connection with Latehar P.S. Case No. 185 of 2025, registered under Section 376(2)(n) of the Indian Penal Code, now pending in the court of learned CJM, Latehar. 3. Learned counsel for the petitioner further submits that the petitioner has been falsely implicated in this case. As per the allegation itself, the victim was in talking terms and was having relationship with the petitioner since 2020. The allegation is that the petitioner made sexual relationship with the victim on the false pretext of marriage. 4. Learned counsel for the petitioner also submits that the petitioner has been in custody since 08.11.2025 and he is a constable in the excise department of the State of Jharkhand. 5. Learned counsel for the opposite party- State, on the other hand, has opposed the prayer and has submitted that the petitioner was already married. 6. To this, learned counsel for the petitioner submits that the victim was throughout major even in the year 2020. The learned counsel has further submitted that charge has not been framed. 7. After hearing the learned counsel for the parties and considering the fact that there is allegation that the petitioner was in relationship with the victim since the year 2020 and the First Information Report has been lodged in the year, 2025 when the 2026:JHHC:10292 2 petitioner refused to marry the victim and also considering the fact that investigation is over, the petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/-(Rupees twenty-five thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Latehar in connection with Latehar P.S. Case No. 185 of 2025, on the following conditions: (i) The petitioner and his wife shall not disturb the victim in any manner. (ii) One of the bailors would be the present pairvikar of the petitioner. (iii) The other bailor should be his close relative. (iv) The petitioner will attend the court on each and every date and on account of even single default, the learned court shall cancel the bail bond furnished by the petitioner. (v) The petitioner will deposit a self-attested copy of his Aadhar Card along with his mobile number before the learned court which he will not change during the pendency of the case without prior permission of the court. (vi) The petitioner shall fully co-operate with the proceedings before the learned trial court. 8. The instant application is allowed with the aforesaid conditions. 9.
